This paper is intended first for the formal argumentation community (see https://comma.csc.liv.ac.uk/). This community develops logics and systems modelling argumentation and dialogues. The community is in search of major applications areas for their models. One such application area e.g. is Law. The message of this paper is that there is another major application area for formal argumentation. There is an international community of sex offender therapist that is well established and well funded, and their therapy methods use (methods that can (...) be modelled by) formal argumentation and logic. This community presents a natural application area for formal argumentation. We thus describe in this paper how the sex offender therapists work, to give the formal argumentation researcher a view of this application area. What is especially important about this application area is that in order to model it and learn from it, the formal argumentation community have to evolve their formal methods and adapt to this new application. Part of this enhancement is to modify and import certain methods from other areas of Logic e.g. from Non-Monotonic logic. The members of the formal argumentation community are not familiar, on average, with other areas of logic, and so we also describe in this paper, what we need from neighbouring logics. This makes this paper of interest also to sex offender therapist as well. They may be already familiar with their own practices, but the additional logics described will be of interest to them. The social contract approach to the study if institutions aims at providing a solution to the problem of compliance with rational agreements in situations characterized by a conflict between individual rationality and social optimality. After a short discussion of some attempts to deal with this problem from a rational choice perspective, we focus on John Rawls's idea of 'sense of justice' and its application to the explanation of the stability of a well-ordered society. We show how the relevant features of (...) Rawls's theory can be captured by a behavioral game theory model of beliefs dependent dispositions to comply, and we present the results of two experimental studies that provide support to the theory. Cet article vise à analyser les racines biologiques et psychopathologiques de l’antisémitisme. Il privilégie la notion de dialectique afin de comprendre la transition de l’anti-judaïsme à l’antisémitisme comme passage d’une opposition d’essence spirituelle et religieuse à un rejet d’ordre national et racial. Historiquement, ce passage est contemporain de l’émergence de la biologie de la race qui a, entre autres, cristallisé les thèmes majeurs d’une tradition mythique, ayant, pendant des siècles, structuré l’identité occidentale. L’antisémitisme proprement dit, dont le terme n’apparaît qu’en (...) 1873, a transformé une opposition dialectique à l’altérité juive en ce qu’Adorno a appelé la « dialectique négative », visant à résoudre définitivement la « question Juive » par la suppression de son objet. A travers une analyse historicoconceptuelle, cet article suggère une nouvelle approche de la genèse du racisme et de l’antisémitisme nazi, d’une part, et des rapports entre la science et l’éthique, d’autre part. This work constitutes the Proceedings of the Bar-Ilan International Symposium on the topic ?Sense and Nonsense in Philosophy and Psychopathology.? The symposium was held at Bar-Ilan University (Israel) from June 7-8, 1993, with lectures given in three languages (English, Hebrew and French). Through this symposium an outline of a philosophy of psychopathology related to biology and ethics was presented. It is now clear, especially from clinical experience, that the notions of sense and nonsense cannot be grasped directly, but must be (...) constructed through a reflective process connected with concepts. Furthermore, since psychopathology is for the most part concerned with the disturbance of intersubjective experience, it is directly related to ethics. For this reason, as clearly illustrated by this symposium, psychopathology could provide an excellent basis for philosophical interrogation. (shrink)

This comment addresses two issues that arise in Sacconi/faillo/ottone's essay. The first is the problem of compliance as it arises in social contract theory. The second is the problem of avoiding an incoherence that arises in the formulation of welfarist principles of distributive justice if these principles are taken to be concerned with the distribution of welfare without restriction. Sacconi, Faillo, and Ottone define an interesting class of principles that govern only the distribution of 'material utility', which they distinguish from (...) 'conformist utility'. Sacconi, Faillo, and Ottone are primarily concerned, however, to argue that there is a need to revise 'the utility maximization model of a rational economic man'. I discuss this claim briefly, in concluding the paper. (shrink)

Jusqu'au IXe siècle, en Orient où l'Empire romain perdure comme en Occident où il n'existe plus, « l'Église » se pense et se vit sur le mode synodal, avec les nuances qu'apporte, ici, l'idéologie eusébienne, donnant le primat au « palais royal » sur le « siège apostolique », et, là, l'augustinienne, qui soutient l'inverse. Deux siècles plus tard, alors que l'Empire byzantin a cessé de prétendre à l'universalité romaine, la chrétienté latine occidentale ne rêve que de renovatio romani imperii, (...) à son bénéfice. Entre ces deux moments, il y a l'éphémère aventure de Gerbert d'Aurillac qui, après avoir défendu à Reims la cause des évêques contre le pape, devint, par la grâce d'Otton III, le pape de l'An Mil, Sylvestre II : c'était le nom que portait le pontife du temps de Constantin, auquel le nouvel empereur ne cesse de se référer, en souhaitant un empire moins germanique qu'universel. Ce dut être une grande joie, pour le pape, d'entendre Otton dire en 1001 : « Nous proclamons Rome capitale du monde et nous reconnaissons l'Église romaine comme mère de toutes les Églises. » Désormais, la communion n'est plus réglée par la lex communis ecclesiae catholicae, mais par 1'unius arbitrium et Sylvestre II parlera en « père universel », conscient d'exercer seul le ministère de Pierre. C'est dans ces fortes convictions que l'Église romaine affrontera la crise de la chrétienté des XIIIe-XIVe siècles. Up until the ninth century, when the Roman Empire continued in the East but ceased to exist in the West, « the Church » thought and lived in the synodal mode. The slight difference was that Eusebien ideology prevailed in the East, which gave primacy to the « royal palace » over the « apostolic seat », while Augustinien ideology held the contrary in the West. Two centuries later, when the Byzantine Empire ceased to pretend to Roman universality, western Latin Christianity dreamed only of the renewal of the Roman Empire, to its own advantage. Between these two moments, there was the ephemeral adventure of Gerbert of Aurillac who, after having defended the cause of the bishops against the pope at Reims, became pope Sylvester II in the year 1000, thanks to Otto III. Sylvester was the name of the pontiff at the time of Constantine, to whom the new emperor didn’t cease to compare himself in wishing an empire less Germanic than universal. It must have been a great joy for the pope to hear Otto say in 1001 : « We proclaim Rome the capital of the world and we recognize the Roman Church as mother of all the Churches. » In the future, communion was no longer regulated by the Catholic Church's common law, but by the unius arbitrium, and Sylvester II will speak as « universal father », conscious of exercising alone the ministry of Peter. It is with these strong convictions that the Roman Church would face the crisis of Christianity in the XIII and XIV centuries. (shrink)

The object of this article is to present, through the example of the birth of the cult of Saint Adalbert, Bishop of Prague, the means by which his hagiographic myth evolved within the ideological and cultural fabric of Poland around the year 1000. By highlighting the various symbolic events marking the official recognition of sainthood of the martyr, beheaded in Prussia in 997, the evolution of the religious conceptions of that period of Christian cultism will be studied in order to (...) understand the dynastic and patriotic influence which has been attributed to Saint Adalbert in Medieval Poland. When are we, in fact, arguing? Even one and the same author may offer more than one definition of what he understands by argumentation: this is partly because the problem of argumentation is not confined to a single area of knowledge or of practical life. Definitions of argumentation are as varied as the different positions taken on the question of what exactly we do when we argue. Be that as it may, we are struck by the fact that the problem (...) of argumentation (above all in its application to hypothetic-inductive methods) has not been analysed as a problem linked to interpretation.
